Using this site constitutes your acceptance of these Terms. If you do not agree, please do not use the site. If you use the site on behalf of an organization, you represent that you have authority to bind that organization.

We aim to keep information accurate and current; however, typographical errors, inaccuracies, and omissions may occur. We reserve the right to correct any errors and to change or update information at any time without prior notice.

3. Bookings & Third-Party Platforms

This website presents accommodation services offered by FOREMAST DOO. You can book via our own booking system or through third-party platforms (e.g., Booking.com, Airbnb). If you use a third-party platform, their terms and policies apply in addition to these Terms.

Calendar sync: Our site uses iCal integrations with Booking.com and Airbnb to synchronize availability. Because third-party updates can experience short delays, availability shown may occasionally differ. In the rare event of a conflict, confirmed bookings take precedence and we will work with you to provide a fair solution (e.g., alternative dates or a refund, as applicable).

4. Prices, Fees & Payments

All prices and fees are subject to change until a reservation is confirmed. Taxes, fees, and exchange rates may vary. All transactions are processed in EUR.

Security Standards for Card Payments

Card payments are processed via our partner AllSecure on a hosted payment form. Key safeguards include hosted card entry (we do not receive or store your full card number or CVV), modern transport encryption (e.g., TLS), gateway PCI-DSS compliance, tokenization where applicable, Strong Customer Authentication (3-D Secure) when required by your bank, and automated fraud checks.

5. Cancellations & Refunds

To cancel a booking made on our site, email contact@st-oliva.com. For third-party bookings, follow the platform’s instructions. Our cancellation policy for direct bookings is:

Any approved refund is returned to the original payment method. Timing of funds appearing in your account depends on your bank or card issuer.

These Terms are governed by the laws of Montenegro. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Kotor, Montenegro, unless mandatory law provides otherwise.

This Privacy Policy regulates the practice of collecting information from users when using the website https://st-oliva.com/, as well as their storage in the databases of our company FOREMAST DOO. Our Privacy Policy covers the reasons how and why we collect, use, and protect your personal data.

TERMS OF SERVICE PROVISION

The service sold through the website possesses the characteristics necessary for the regular use of such services in accordance with its purpose, as defined in the LAW ON CLASSIFICATION OF ACTIVITIES (https://montenegro.eregulations.org/media/Zakon%20o%20klasifikaciji%20djelatnosti.pdf). The conformity of the service with the contract is determined EXCLUSIVELY according to the characteristics and purpose of the service as defined in the terms of use on our website.

The sales price of services is indicated with each service, and the possibility of purchasing services under special price benefits or promotional incentives (special offers) is carried out in accordance with the conditions published on our website.

We strive to be as precise as possible in the description of products, display of images, and prices, but we cannot guarantee that all information is complete and error-free. Images do not have to be 100% identical to the products. All items displayed on the site are part of our offer and do not necessarily imply availability at all times.



ORDER ACCEPTANCE

After placing an order, you will be notified about the status of your order via the email address you provided during the ordering process. The order is considered accepted by the company FOREMAST DOO only after we send you an email confirmation of acceptance.



FULFILLMENT OF SERVICES

The execution of the service by the legal entity FOREMAST DOO implies the preparation of accommodation capacities before the Check-In date defined in the booking process. The company FOREMAST DOO is obliged to fulfill all agreed services from the booking process for the entire duration of the previously defined stay.



INABILITY TO PROVIDE SERVICES

In the event that the legal entity FOREMAST DOO is unable to fulfill the agreed services, the customer has the right to cancel the purchase, and in that case, all money related to that service will be refunded.



PAYMENT METHODS

Payment for products in our online store can be made in one of the following ways: by payment cards - VISA, Maestro, or MasterCard that support online payments. Card payments are processed in cooperation with AllSecure doo and NLB Banka Joint Stock Company and are carried out in a secure and certified way through the AllSecure Payment Gateway, by simply entering the payment card details.

After entering the card details and confirming the payment, the bank authorizes the transaction, and the order is then approved and enters the further preparation process for delivery. The amount will be reserved on your card (account) and will not be available for other purposes.

The transaction will be completed and the amount deducted from your account only when the products are prepared for transport and handed over to the courier service. In case the payment is not completed, i.e., the amount is not deducted from the account within 14 days from the acceptance of your order, that order will be canceled and deleted. After the 14-day period expires, the funds reserved on your account will be released and made available to you again. After that, you can repeat the same or make a new order and complete the payment for them.

Please check with the bank that issued your card whether your card supports online payments.

If you do not have a card that supports online payments, there is an option for direct payment to the service provider's account in accordance with the reservation instructions, which are sent by email (the "Reserve and Pay Later" option).





PAYMENT PROCESS

When entering payment card information, confidential data is transmitted over a public network in a protected (encrypted) form using the SSL protocol, applying the most advanced tokenization methods for sensitive data, and in accordance with PCI-DSS standards. At no point are payment card details available to the merchant.

3D Secure protection for all merchants and customers – AllSecure Payment Gateway uses the highest global standards of data protection and privacy. All merchants using the AllSecure Payment Gateway are automatically included in 3D-Secure protection, ensuring safe purchases for customers. Customers’ card numbers are not stored in the merchant’s system, and the entry itself is protected by SSL data encryption.

PCI DSS Standards – AllSecure Payment Gateway is continuously aligned with all requirements of card organizations in order to increase the security level for merchants and customers. From 2005 until today, without interruption, the system has been certified as PCI-DSS Level 1, which represents the highest standard in the industry. The PCI Data Security Standard (PCI-DSS) defines the necessary security measures for processing, storing, and transmitting sensitive cardholder data. PCI standards protect sensitive cardholder information throughout the entire payment process: from the moment data is entered at the merchant’s point of sale, during communication between the merchant and the relevant banks and card organizations, as well as during later storage of such data.



When the customer’s card data, at their request or by the merchant’s decision, is TOKENIZED (securely stored for later use), such data is stored on AllSecure PCI-DSS Level 1 certified servers. Tokenized card data is transmitted in a completely secure and certified manner. The merchant never has access to the card number or other sensitive data; instead, they receive a reference number (token) which only they can use in accordance with the terms agreed with the customer. The customer has the option to deregister a previously registered card, as well as to update the details of an already tokenized card.

The company FOREMAST DOO assumes no responsibility for customer errors, incorrectly purchased products, or any other mistakes related to your actions when shopping on the website. If you encounter irregularities during the purchase of products on the website or did not receive the purchased product, please contact customer service (contact details), and we will do our best to correct the irregularities so that you receive the purchased product.



CANCELLATION AND REFUND PROCESS

The law on distance contracts establishes the right of the customer, who is considered a consumer (a natural person renting accommodation for personal use, not for professional activity), to withdraw from the rental agreement within 14 days from the day the reservation was confirmed. When withdrawing, the customer may, but is not required to, state the reasons for cancellation. The Withdrawal Form/Statement produces legal effect from the day it is sent to the provider. In case of withdrawal from the agreement, the consumer has the right to a refund or to change the booking for another available accommodation unit.

The refund is issued after the cancellation request is received and after it is confirmed that the apartment has not been used and the check-in date has not yet started. The customer is obliged to submit the cancellation without delay, and no later than 14 days from the day the withdrawal form was sent. After the 14-day period expires from the day of submission, the reservation can no longer be canceled under this right.

In case of refund, the accommodation must remain in unused and undamaged condition, in accordance with the booking terms and conditions. If the stay has already started or the apartment has been used in any way, the customer is fully responsible for any loss of value, and the refund may be reduced or denied accordingly. If it is determined that damage or improper use occurred due to the customer, the refund will be refused, and any costs will be borne by the customer.

The provider is obliged to return to the consumer, without delay, the amount paid under the agreement, and no later than 14 days from the day of receiving the withdrawal statement, provided that the rental period has not yet started.



STATEMENT ON CURRENCY CONVERSION

All payments will be made in euros (€). If the payment is made using payment cards issued by foreign banks, the transaction amount will be converted into the local currency of the cardholder, according to the exchange rate of the card networks Visa/Mastercard."
